  1. PREAMBLE

The website www.sabemasson.com (hereinafter referred to as the "Site") is published by the company Parfumaré SAS, a Simplified Joint Stock Company with a capital of 30,000 euros, whose registered office is located at 35 rue debelleyme, 75003, Paris (France), registered with the RCS of Paris under number 510 457 518, VAT number: FR04510457518, acting on its own behalf (hereinafter referred to as "Parfumaré").

Access to the Site and any order are subject to these General Terms and Conditions of Sale. We recommend that you read them carefully.
These General Terms and Conditions of Sale apply to the consultation of the Site and also aim, on the one hand, to inform you about online sales and the delivery of products ordered on the Site and, on the other hand, about your rights and obligations in the context of the sale of these products. They apply, without restriction or reservation, to all sales of all products, gift vouchers, and institutes included, offered on the Site.

The Site is accessible via the Internet network, open to any user of this network. The implementation of the computer means allowing access to the Site and the access costs are at your expense. Parfumaré cannot be held responsible for damages resulting from the use of the Internet network, in particular but not exclusively due to bugs, computer viruses, or interruption of service.
Sales on the Site are reserved for non-trading physical users, adults, and with the legal capacity to contract.

 

  1. APPLICATION OF THE GENERAL TERMS AND CONDITIONS

The consultation of the Site and any order placed by the internet user or the buyer (hereinafter referred to as "the Customer") are governed by these General Terms and Conditions of Sale.

Therefore, the Customer declares to accept without restriction or reservation all the provisions of these conditions.

By consulting and navigating the website www.sabemasson.com, the Customer undertakes not to use it for illegal or prohibited purposes, including attempting to obtain unauthorized access to a password-protected area of the site or accessing Parfumaré's computer system by hacking or any other means.

 

  1. INTELLECTUAL PROPERTY

Access to the Site grants the Customer a right of private and non-exclusive use. This Site and all its contents, including but not limited to trademarks, texts, logos, designs, images, sounds, etc., are the property of Parfumaré and are protected by the provisions of the Intellectual Property Code. Any use of the contents, names, and trademarks, including their reproduction, representation, or, more generally, their exploitation, in whole or in part, by any means and on any medium whatsoever, without the prior written consent of Parfumaré is prohibited and constitutes an act of infringement, punishable criminally and civilly. Similarly, the creation of Internet links to or from the Site, the creation of "mirror" sites, containing all or part of the Site, is strictly prohibited

 

  1. PRODUCTS

4.1 Customer Service

4.2 Informations

Prior to placing any order, the Customer may familiarize themselves with the essential characteristics of the product(s) they wish to order by clicking on the product on the Site. Certain products may be limited in quantity per order. Parfumaré makes its best efforts to ensure that the presentation of the products on its Site is faithful to the products delivered. However, for readability reasons, the images are not reproduced to scale and, due to the mode of presentation on the Internet, Parfumaré cannot guarantee that the product delivered will correspond in all respects to the perception the Customer had when placing their order. Descriptions, illustrations, references, characteristics, content, specifications, price, and availability of any product are subject to change without notice.

4.3 Availability

The products offered for sale are those displayed on the Site at the time the Customer consults it and within the limits of available stock. Parfumaré reserves the right, without notice, to limit the quantity available, to suspend the sale of any product, to modify, improve, and evolve its products. Some products displayed or described on the site may not be available or authorized for sale in all countries. In case of unavailability after ordering, Parfumaré informs the Customer as soon as possible by email that the expected delivery will be either partial or canceled. If the Customer's bank account or Paypal account has been debited and the order cannot be fulfilled, Parfumaré undertakes to refund the Customer the amount corresponding to the undelivered products, no later than thirty (30) days following the date of payment deduction from their bank account or Paypal..

4.4 Prix

The prices applicable are those specified on the Site at the time the Customer validates their order. Prices are mentioned in euros and are inclusive of all taxes. Parfumaré reserves the right to apply different prices depending on the delivery countries and to modify, without notice, the price of its products without, however, these modifications affecting already accepted orders.

The applicable delivery costs, borne by the Customer, are mentioned as such in the order summary before validation. These delivery costs vary depending on the country where the products are delivered and the delivery method chosen by the Customer.

For certain countries in the Territory, the Customer may be asked to pay customs duties or any other specific fee relating to the legislation of the importing country in addition to the amount of the order.

 

  1. ORDERS

5.1 Customer account

The creation of a Customer account, with a username and password, is mandatory to access certain pages of the site and to purchase the products presented there. To this end, the Customer agrees to provide complete, current, and accurate information about themselves and to keep it up to date. The Customer agrees, in particular, to provide

Their full name(s), first name(s), and a valid and operational email address.

A complete postal address, to which delivery must be made, and the names and first names of the recipient, if different from those of the Customer. This information is necessary for the successful completion of the Customer's order and its delivery. The creation of the Customer account and the execution of orders placed are impossible if a mandatory mention or information is missing. The Customer is solely responsible for the confidentiality of the username and password used to access their account on the Site.
The Customer agrees not to disclose their username or password. They acknowledge that they are fully and solely responsible for any activity or action carried out from their Customer account, whether or not they have authorized such activity or action. They must immediately inform Parfumaré of any unauthorized use of their account.

5.2 The Cart

Each item you wish to select must be added to the cart. A summary of the selected products, their quantity, and price is displayed by clicking on the "Order" button. This summary can be reviewed, modified, and supplemented with a promotional code before validating the order. The order is validated by clicking on "Proceed to payment". By clicking on the "Proceed to payment" button, the Customer agrees to read these General Terms and Conditions of Sale, to check the box "I have read and accept the General Terms and Conditions of Sale", and to proceed with payment for their order. Failure to accept will result in the order not being validated

5.3 Electronic Signature

The double "click" by the Customer validating the order constitutes an electronic signature which, between the parties, is equivalent to a handwritten signature.

5.4 Payment Methods

Once the order is validated and the General Terms and Conditions of Sale accepted, the Customer is redirected to a secure Internet page to proceed with the online payment of their order. Payment is made exclusively in euros by credit card or PayPal account, to the exclusion of any other means of payment:

By Credit Card (Visa, Mastercard). The transaction is securely processed through the PayPal payment service. All data entered during payment by credit card is immediately encrypted using SSL protocol and stored on PayPal's server. No confidential payment data is stored by Parfumaré. In case of return of an item, the refund will be credited to the account used for the payment of the original order.

By PayPal. This payment method is offered to Customers with a PayPal account. Financial and personal information is automatically encrypted when sending any sensitive information to PayPal's servers. In case of return of an item, the refund will be made in the form of a credit to the PayPal account used for the payment of the original order.

The Customer guarantees Parfumaré that they have the right to use the chosen means of payment. In case of refusal by the bank, the order is automatically canceled and Parfumaré informs the Customer. Parfumaré also reserves the right to take any necessary legal action. Parfumaré retains ownership of the goods ordered by the Customer until full payment of the corresponding price. Parfumaré also reserves the right to suspend any order from a Customer with whom there is a dispute regarding the payment of a previous order. Upon validation of payment, a detailed acknowledgment of receipt, an electronic ticket, or an order confirmation is sent to the Customer's email address within a maximum period of forty-eight (48) hours. This ticket or confirmation includes the order references, the exact amount charged, the delivery terms of the order, and the Customer's right of withdrawal. Parfumaré recommends keeping this information for reference.

5.5 Order Confirmation

Contractual information will be confirmed by email before delivery. Any incomplete, incorrect, or fraudulently paid order using a credit card will be rejected.

5.6 Proof of Transaction

The computerized records kept in Parfumaré's computer systems under normal security conditions will be considered as evidence of communications, orders, and payments between the parties.

6. DELIVERY AND RECEIPT OF THE ORDER

6.1 Delivery Locations

Delivery of your order is possible in the following countries or regions: Metropolitan France, French Overseas Departments (except Martinique and Guadeloupe), Corsica, Monaco, United Kingdom, Germany, Austria, Netherlands, Portugal, Italy, Cyprus, Croatia, Estonia, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Poland, Czech Republic, Romania, Slovenia, Slovakia, to the delivery address indicated by the Customer during the ordering process.

6.2 Shipping Rates and Delivery Times

Shipping costs vary depending on the delivery country and the total weight of the order. The delivery costs are mentioned in the order summary before the Customer's validation. By validating their order, the Customer is deemed to have accepted the corresponding delivery costs and agrees to pay them.

These deadlines start from the first working day following receipt of payment.

Delivery is provided by a third-party provider (the "Provider"). The Customer acknowledges that Parfumaré cannot be held responsible for non-performance, improper performance, or delay in delivery if such issues are attributable to the Customer (for example, incomplete or incorrect address), the Provider, or a force majeure event. However, the Customer is encouraged to inform Parfumaré in writing of any delivery delay so that necessary inquiries can be made with the Provider. In case of a delivery delay exceeding ten (10) working days attributable to Parfumaré, the Customer has the option to request the cancellation of their order without any charges by contacting Parfumaré's customer service in writing.

6.3 Advice and Obligations Upon Receipt

Suivant le mode de livraison choisi, le destinataire de la commande peut être invité à signer le récépissé remis par le Prestataire. En cas d'absence, le destinataire du produit commandé reçoit du Prestataire les instructions à suivre pour retirer sa Commande ou solliciter une nouvelle livraison.

En tout état de cause, la livraison est réputée avoir été effectuée au moment de la mise à disposition par le Prestataire (en main propre, dans la boîte aux lettres ou au lieu de retrait prévu par le Prestataire) de la Commande auprès du Client ou de toute autre personne désignée dans la commande, le système informatique dudit Prestataire faisant foi. Le Client est donc invité à suivre le bon acheminement de son colis via le service de suivi proposé par le Prestataire.

Dès réception, le Client est tenu de vérifier le contenu du colis, de mentionner auprès du Prestataire toutes réserves ou réclamations en cas de retard ou endommagement du colis et de signer le récépissé de livraison ou de refuser le colis. Les réserves ou réclamations exprimées devront être confirmées par écrit aux services du Prestataire assurant la livraison et au service clientèle de Parfumaré dans le délai maximum de trois (3) jours. A défaut, le Client reconnaît avoir reçu les produits et dans un état donnant toute satisfaction.

 

  1. RETOUR ET DROIT DE RETRACTATION

7.1 Withdrawal

According to the selected delivery method, the recipient may be requested to sign the receipt provided by the delivery provider. Should the recipient be unavailable at the time of delivery, instructions will be provided by the provider on how to retrieve the order or arrange for a new delivery.


7.2 Methods of Exercising the Right of Withdrawal and Returning Products

The Customer, wishing to exercise their right of withdrawal, must:

  • Return the products without undue delay and no later than fourteen (14) days following the communication of their decision to withdraw, to the address provided and with the withdrawal number provided by email.
  • The products must be returned in their original unopened packaging, in perfect condition, unused, and accompanied by all accessories (including gifts).

7.3 Refund Procedures

The total amount paid for the returned products, including the initial delivery costs of the order, is refunded by Parfumaré, except for the return shipping costs which are borne by the Customer. Refunds are processed within a maximum period of fourteen (14) days from the receipt of proof of shipment of the products or, failing that, from the date of effective recovery of the products. If the right of withdrawal is exercised after the date of shipment of the products by Parfumaré, the return costs of the product(s) and associated risks remain the responsibility of the Customer. The refund is made by crediting the credit card or by crediting the Paypal account used for payment.

7.4 Exclusions

The Customer acknowledges that failure to comply with the procedure described above and the specified deadlines will result in no refund being issued. Any returned product that is opened, damaged, incomplete, used, deteriorated, or consumed, even partially, will not be eligible for a refund. Additionally, the right of withdrawal is excluded for products that have been unsealed after delivery, which cannot be returned for reasons of hygiene or health protection.

 

  1. LEGAL WARRANTY

Parfumaré warrants that its products conform to their intended use and are free from any defects or hidden faults that would render them unfit for their normal use. Parfumaré's warranty does not cover products damaged during transport or due to misuse.

 

  1. PERSONAL DATA, IT AND FREEDDOM OF INFORMATION 

9.1 Declarations to the CNIL

This website has been declared to the National Commission for Information Technology and Civil Liberties (CNIL). The Customer is informed that the automated processing of information, including the management of users' email addresses, has been declared to the CNIL under number 165078.

9.2 Data collected

Parfumaré collects personal data in the context of creating a customer account and placing orders. This data is intended for Parfumaré and used to ensure the management, execution, and delivery of orders and their follow-up (invoices, returns, cancellations, warranties). This information is transmitted to Parfumaré's partners, whose involvement is necessary for the successful completion of the customer's orders and deliveries (transporters, banks, etc.). Information and data marked with an asterisk (*) are mandatory and necessary for the successful completion of the customer's order and delivery. Personal data is only kept for the duration strictly necessary for the processing purposes mentioned above, namely five (5) years for billing and (3) years for marketing.

9.3 Electronic Communication

By registering on the website www.sabemasson.com, the Customer consents to receive electronic communications from Parfumaré, including order confirmations, emails, newsletters, or product information. Parfumaré reserves the right to use the data provided by the Customer for commercial purposes if the Customer accepts it during the collection of their personal data, by checking the following options: "I wish to receive offers from Parfumaré" and "I wish to subscribe to Parfumaré's partner newsletter". Otherwise, the Customer will not receive any offers or newsletters. The Customer may, at any time, opt out of receiving the aforementioned offers and newsletters by clicking on the unsubscribe link provided in the offers and newsletters sent to them.

9.4 Privacy Policy

Parfumaré is committed to protecting the privacy of its customers. The Privacy Policy applies to the collection, use, and disclosure of personal data of all users of the website www.sabemasson.com, and Parfumaré makes its best efforts to keep this personal data secure. By using the website www.sabemasson.com, the customer acknowledges and accepts the processing of their personal data.

9.5 Right of access, modification, rectification, anonymization, portability, and deletion of data

The Client has the right to access, rectify, modify, anonymize, delete, and transfer their personal data. The Client also has the right to object, for legitimate reasons, to the processing of their personal data.

To exercise any of these rights, the Client can send their request to Parfumaré at the following postal address: 35 rue debelleyme, 75003 (France) or to the following email address: contact@sabemasson.com, providing proof of their identity (name(s), surname(s), postal and email address, copy of ID). Parfumaré undertakes to process the Client's request as soon as possible.

In accordance with the "informatique et libertés" law of January 6, 1978, in its latest version, Parfumaré undertakes to take all necessary precautions to preserve the security of personal data concerning users of the Site, in particular to prevent these data from being distorted, damaged, or accessed by unauthorized third parties.

In accordance with the "informatique et libertés" law of January 6, 1978, in its latest version in force, you have a permanent right of access, modification, rectification, and opposition to the information concerning you.

The Client also has the possibility to modify or correct their personal data directly by accessing their "My Account" space on the "sabemasson.com" Site. 

9.6 Cookies

In order to allow for optimal navigation on the Site, Parfumaré may use cookies on the Users' computers with their express authorization. These cookies enable the storage of information related to navigation on the Site, as well as any data entered by the Users.

Users have the option to block, modify the retention period, or delete these cookies via their browser interface. If the systematic deactivation of cookies on the User's browser prevents them from using certain services or features of the Site, this malfunction shall not constitute any damage to the User, who cannot claim any compensation as a result.

9.7 Résiliation

The Customer may terminate their access to the website www.sabemasson.com and close their Customer account at any time, with or without reason, with or without prior notice. In the event of termination for any reason, access to and use of the Site will cease immediately.

 

  1. FORCE MAJEURE

Parfumaré shall not be held liable if the non-performance or delay in the performance of any of its obligations described in these General Terms and Conditions of Sale results from a fortuitous event or the occurrence of a force majeure event, including but not limited to floods, fire, storm, partial or total strikes, and, more generally, any external, unforeseeable, and irresistible event.

 

  1. MODIFICATION OF THE GENERAL TERMS AND CONDITIONS OF SALE

If one or more clauses of these General Terms and Conditions of Sale are declared or become invalid due to the application of the law, a regulation, or a judicial decision, the other clauses shall retain their full validity and effect. Furthermore, given the possible evolution of regulations and the Site, Parfumaré reserves the right to modify these General Terms and Conditions of Sale at any time.
The new General Terms and Conditions of Sale will be available online on the sabemasson.com website and will apply only to consultations and sales made after the modification is made

  1. APPLICABLE LAW

All disputes relating to orders placed, sales fulfilled, and the interpretation and execution of these General Terms and Conditions of Sale are subject to French law, excluding the United Nations Convention on Contracts for the International Sale of Goods

  1. TRIBUNAL COMPETENT

Any dispute or disagreement arising from orders placed, sales executed, the validity, interpretation, or execution of these General Terms and Conditions of Sale that has not been resolved amicably by the Customer and Parfumaré shall be submitted to the French courts, notwithstanding any plurality of parties, whether in summary proceedings, on the merits, or through expert examination.
